@hollytoo Casey would probably make up an equally no-sense making convoluted lie about an accident and deadly agent chloroform, as she did with police lying about kidnapping and non-existant people, repeating job lie not two seconds after confessing she didn’t actually work, her leading police down a hall to a Universal office she didn’t have, claiming she dropped off Caylee at an apt they didn’t have footage of her at to go to that job she didn’t have. Already trying lie about the duct tape.
Another problem with this defense – how is she going to explain the chloroform and neck breaking searches on the computer?
The problem with this case is that the girl is probably not a killer, it was probably an accident and she covered the mouth and body to prevent fluids from escaping. Her inability to even admit that though will be enough cause for a jury to convict her but they won’t sentence to death because there will be that doubt there. I would convict her based on her unwillingness to tell the truth alone – but nobody is going to hand down that death penalty. I can guarantee it.
And the jury is not going to pass out the death sentence period. They just won’t. She’s too young and the crime is obvious to most but ambiguous in spots as to proof, enough so to leave a glimmer of doubt that most would not want to live with and the sentence would be life without parole anyway.
And no, they can not prepare her properly at all because she is a compulsive liar but for that juror it won’t matter, I don’t think she will be able to tell the difference. The juror will be susceptible to influence by other jurors without that personal testimony though and that is the only juror they should concern themselves with from a defense point of view because that is the one that has religious convictions that prevent her from judging and is also not very bright. Not nice but true.
She is going to have to testify for the juror who said (twice) that she would not convict based on the words of someone else. For everyone else, they’ll have better sense than that no matter whether she takes the stand or not. For mistrial purposes, the ace in the hole is the religious woman and she’ll need to take the stand for her.
